Federal Court Orders Release of Kilmar Abrego Garcia from ICE Detention
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing detainment lacks legal authority.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which US authorities later acknowledged was an error. After his return to the United States to answer alien smuggling allegations, he was held in immigration custody.
In her order, the judge pointed out that the authorities lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
